What did you expect?  We live under a fascist regime.  These federal judges have no power against it.
There are two ways to get Cheney.  One is for Congress to impeach and convict him his other crimes, but that isn't going to happen.

Especially when they were appointed by him.

The claim is that it was the wrong court to be trying it in, but I find that a poor excuse at best.  Plame has stated she'll move the case to the next court and keep the fight on.

It's tilting at windmills though.  Bush will just commute the sentence and then pardon at the end.  Why commute the sentence?  If pardoned, the person is not allowed to swear the fifth based on those charges.  It's why Libby wasn't pardoned.

Suppose it ever got to the Supreme Court?  All Roberts would is say, "Git outta here!," and kick it back down to the appeals court.  No certiorari, no chance!
